General Terms and Conditions of HBZ Matt AG / Hotel & Bildungszentrum Matt

1. scope of application

These General Terms and Conditions (hereinafter referred to as GTC ) of HBZ Matt AG (hereinafter referred to as HBZ Matt ) apply to the provision of conference, banquet and seminar facilities as well as to all other related services and deliveries and/or the provision and rental of hotel rooms. In the following, all genders are meant, even if the generic masculine is used in these GTC. The GTC of HBZ Matt apply exclusively. Terms and conditions of the organizer, contractual partner or hotel guest (hereinafter referred to as the customer ) shall not become part of the contract even if they have not been expressly contradicted. Deviations from these GTC must be explicitly agreed by the parties in writing in the contract. HBZ Matt reserves the right to amend these GTC at any time. The GTC valid at the time the contract is concluded shall apply, even if the service is purchased at a later date.


2. prizes

All prices are quoted in Swiss francs and include the VAT applicable at the time of performance. We reserve the right to make any price changes between the time of booking and the time of performance and will inform the customer in writing at least one month before the agreed booking.


3. conclusion of contract

A contract is concluded between the customer and HBZ Matt when an offer from HBZ Matt has been confirmed in writing by the customer, an inquiry from the customer has been confirmed in writing by HBZ Matt or a service has been booked via the website. Changes to the content of the contract are only binding once they have been confirmed in writing by HBZ Matt. The customer must send HBZ Matt a list of participants with the following details no later than 14 days before arrival: First and last name of all guests, time of arrival, allergies or menu requests as well as the payment conditions of the guests (self-pay or payment by the customer).


4. terms of payment

HBZ Matt invoices are due for payment within 10 days of the invoice date without deduction, after which HBZ Matt is entitled to charge interest on arrears at a rate of 5% p.a. If individual services (e.g. consumptions, hotel rooms, treatments, etc.) are to be paid for by the customer's employees, auxiliary persons or event participants, the customer must coordinate and ensure this for the persons concerned on his own responsibility, otherwise he is liable for the total amount. The invoiced services shall be deemed to have been provided in full and properly if the customer does not report any complaints within the payment period. HBZ Matt is entitled to demand an appropriate down payment at any time. The amount of the down payment and the payment dates are agreed in writing in the contract. If the customer does not fulfill his obligation to pay the deposit on time, HBZ Matt is entitled to withdraw from the contract after setting a reasonable grace period and to allocate the rooms and / or premises elsewhere. The customer shall be liable to HBZ Matt for any damages incurred as a result.


5. withdrawal from the contract by the customer (cancellation and postponement)

Cancellations of events or hotel bookings must be communicated as early as possible and in writing. The following cancellation terms and conditions apply both to cancellations of bookings and to no-shows and early departures. Cancellation costs for booked and confirmed services for an entire group are as follows

- up to 3 months before arrival: 25%

- up to 2 months before arrival: 50%

- up to 1 month before arrival: 75%

- up to 2 weeks before arrival: 85%

- up to 1 week before arrival: 100%

Cancellations of individual hotel room bookings (up to a maximum of 5 rooms) for group bookings must be notified to HBZ Matt AG in writing at least 2 days before the date of arrival, otherwise they will be charged in full. In the event of cancellation or postponement of individual hotel room bookings or postponement of group bookings, the same fees apply as for the cancellation of group bookings.

6. withdrawal from the contract by HBZ Matt

HBZ Matt is entitled to withdraw from the contract at any time for good cause. Important reasons are in particular official requirements and prohibitions, safety aspects and cases of force majeure as well as other circumstances for which HBZ Matt is not responsible or which it cannot influence. In such cases, HBZ Matt will assist the customer in organizing suitable replacement capacities at the customer's request. The customer cannot assert claims for damages against HBZ Matt in any of the above cases.


7. room occupancy & room use

On the day of arrival, the hotel rooms can be occupied from 3.00 pm. Check-out on the day of departure must take place by 10.00 am. Booked conference, banquet and seminar rooms are available in accordance with the contractual agreement.


8. meals / bringing along food and drinks

Meals included in the booked service but not consumed will not be reimbursed. HBZ Matt is free to decide independently on the organization of the catering (plate service or buffet form) for groups of less than 15 people. Any deviations from this must be specified in the contract. The customer, his employees, assistants or event participants may not bring any food or drink to the event or into the hotel room. Exceptions require the written consent of HBZ Matt. In such cases, a contribution to cover overhead costs (service charge/tap fee) will be charged. HBZ Matt can be asked about the amount of this fee if required.


9. liability

The customer shall be liable for the entire invoice amount, including the services purchased by its employees, auxiliary persons and the event participants. Exceptions must be agreed in writing. The customer shall be liable for all damages and losses incurred by HBZ Matt through him, his employees, auxiliary persons or event participants. Proof of fault is not required. HBZ Matt is not liable for theft of or damage to items brought in by the customer, its employees, assistants or event participants. This also applies to vehicles parked in the hotel parking lots, the checkroom and all accessible rooms. HBZ Matt is only liable in the event of intentional or grossly negligent contractual or non-contractual damage and only for direct damage. Any further liability, in particular for slight or medium negligence or for indirect damage such as, in particular, loss of profit, is excluded. Liability for auxiliary persons of HBZ Matt is also completely excluded.


10. banquets and conferences

HBZ Matt reserves the right to make changes to the premises independently, provided that the premises meet the requirements and interests of the customer and are justifiable, and unless explicitly stated otherwise in the contract. Any subletting or re-letting of rooms or areas by the customer requires prior written approval. Unless otherwise stipulated in the contract and insofar as necessary, the customer shall obtain any necessary authorizations himself and at his own expense. Copyright compensation in connection with music performances must be registered and settled by the customer himself.


11. number of participants

In the case of group bookings, the customer must inform HBZ Matt of the definitive number of participants at least 7 working days before the event. If the actual number of participants is subsequently lower, the stated number of participants shall be used as the basis for invoicing (e.g. for meals, place settings, refreshments during breaks, etc.); if the actual number of participants is higher, the actual costs incurred shall be invoiced. In this case, HBZ Matt cannot guarantee that all guests will be accommodated. Section 5 applies to the calculation/cancellation of booked hotel rooms.


12. fire regulations / decoration material / safety regulations

The customer undertakes to comply with the fire police regulations of HBZ Matt, in particular to keep escape routes clear, to comply with the smoking ban, etc. and to observe the house rules. Decoration material brought in by the customer must comply with the fire police regulations and always requires the prior approval of HBZ Matt.

Furthermore, the customer is responsible for ensuring that no more people are admitted than the capacity of the room in question according to the maximum number specified by HBZ Matt. HBZ Matt accepts no liability in this respect.


13. data protection

With regard to data protection, HBZ Matt's privacy policy applies (see website).


14. technology

HBZ Matt has the latest seminar technology at its disposal. Each customer is responsible for the functioning, installation and compatibility of the equipment they bring with them (laptop etc.). It is recommended to test the technology in advance. The projectors have VGA & HDMI connections.


15 Further provisions

Should one or more provisions of these GTC be or become wholly or partially invalid, ineffective or otherwise unenforceable for any reason, this shall not affect the validity of the remaining provisions of these GTC. The parties undertake to work together in good faith to replace such a provision with another provision that comes as close as possible to the intended economic purpose. HBZ Matt reserves the right to transfer outstanding claims of the customer to third parties for collection purposes.

By concluding the booking contract, the customer confirms that he/she has taken note of and understood the content of these GTC and acknowledges and complies with them in their entirety.

If written form is required in these GTC, this also means e-mail. The customer must prove that an e-mail sent by him to HBZ Matt was received by the latter.


16 Applicable law and place of jurisdiction

All contractual relationships between the customer and HBZ Matt as well as these GTC are subject to Swiss substantive law, excluding the provisions of the Swiss Federal Act on Private International Law. All disputes between the parties in connection with the application, interpretation and execution of the contract concluded between them and these GTC shall be decided by the ordinary courts of the Canton of Lucerne. The exclusive place of jurisdiction is Lucerne. In the case of contracting parties who have their place of residence or business abroad, Lucerne shall be deemed to be the special domicile within the meaning of Art. 50 para. 2 of the Federal Debt Enforcement and Bankruptcy Act.
